This Owner Agreement ("Agreement") governs the listing of items for rent on the Nerbor platform. By publishing a listing, the item owner ("Owner") acknowledges and agrees to the terms below.
1. Item Condition Guarantee
- The Owner certifies that all listed items are in safe, working condition and accurately described in the listing at the time of publication.
- The Owner shall not list items that have known safety defects, missing safety guards, or that are otherwise unfit for their intended use.
- If item condition changes after listing, the Owner must update the listing description or pause the listing until the issue is resolved.
2. Listing Accuracy
- All listing photos must accurately represent the actual item being offered for rent.
- The make, model, condition grade, and description must truthfully reflect the item. Misrepresenting item condition or capabilities may result in account suspension.
- Pricing must be clearly stated. The Owner shall not add hidden fees or charges outside the platform.
3. Availability Commitment
- The Owner commits to making the item available for confirmed bookings at the agreed-upon times and location.
- If the Owner cannot fulfill a confirmed booking, they must cancel through the platform as early as possible. Repeated cancellations may affect the Owner's account standing.
- The Owner should use the blackout calendar to block dates when the item is unavailable, rather than declining booking requests after they are made.
4. Maintenance Standards
- The Owner is responsible for maintaining the item in safe operating condition between rentals.
- Regular maintenance, basic safety checks, and any manufacturer-recommended care are the Owner's responsibility.
- The Owner must ensure all listed items are in safe working condition before each rental.
5. Insurance & Liability
- The Owner acknowledges that Nerbor does not provide insurance. The Owner is encouraged to maintain appropriate homeowner's or renter's insurance covering rental use.
- The Owner is responsible for any liability arising from item defects, pre-existing damage, or failure to maintain items in safe condition.
- Deposit holds are placed on the renter's card and provide real fund reservation, but do not replace proper insurance coverage.
6. Photo Documentation
- The Owner is encouraged to photograph the item before each rental handoff and upon return using the platform's condition documentation feature.
- Condition photos help protect the Owner in the event of a damage dispute and establish the baseline state of the item.
- Failure to document item condition may limit the Owner's ability to claim damages against the security deposit.
7. Prohibited Items
- The Owner shall not list items that are stolen, have liens against them, or that the Owner does not have legal authority to rent.
- Items that require specialized licensing or certification to operate must be clearly marked in the listing description.
- Weapons, hazardous materials, and any items prohibited by local, state, or federal law may not be listed.
8. Platform Fees & Payouts
- The Owner agrees to the platform fee structure as described in the Terms of Service.
- Payouts are initiated after a review period following booking completion. The standard review period is 24 hours, but may be extended up to 7 days based on risk factors such as the renter's booking history, rental value, and whether return condition photos were submitted. The estimated payout date is displayed on the booking detail page. Funds typically arrive in the Owner's bank account within 1–2 business days after the transfer is initiated.
- If a dispute is filed, the payout for the affected booking may be held until the dispute is resolved.
- Late fees collected from the Renter are included in the Owner's payout, minus the platform commission (15%). The Owner may waive late fees at their discretion.
9. Chargebacks and Balance Recovery
- If a renter initiates a chargeback (payment reversal through their bank) on a booking for which the Owner has already received a payout, the Owner's proportional share of the disputed amount will be recorded as an outstanding balance on the Owner's account.
- Outstanding balances are automatically deducted from the Owner's future payouts until the balance is fully recovered. The Owner acknowledges and agrees to this deduction mechanism.
- If Nerbor successfully contests the chargeback, the outstanding balance will be credited back to the Owner's account and reflected in the next payout.
- The Owner can view their current balance, deduction history, and any outstanding amounts in their earnings dashboard.
- If the outstanding balance cannot be recovered through future payouts within 180 days, Nerbor reserves the right to pursue recovery through other means, including but not limited to direct invoicing or collections.
10. Cancellation Penalties
- Owner-initiated cancellations within 48 hours of the booking start time may result in a cancellation fee and negatively impact the Owner's listing visibility and account standing.
- Nerbor reserves the right to provide the renter with a full refund for Owner-initiated cancellations, regardless of the cancellation policy.
11. Dispute Cooperation
- The Owner agrees to participate in good faith in any dispute resolution process initiated through the platform.
- The Owner shall provide requested documentation, photos, and communications in a timely manner.
- Nerbor's determination on disputes regarding security deposits and refunds is final, subject to the Terms of Service.
12. Tax Responsibility
- The Owner is responsible for reporting and paying any applicable taxes on income earned through the platform.
- Nerbor may collect and remit sales tax or other transaction taxes as required by law, but the Owner remains responsible for income tax obligations.
- Nerbor may provide tax reporting documents (e.g., 1099 forms) as required by applicable regulations.
13. Automatic Booking Completion
- If neither party marks the item as returned within 7 days after the scheduled end time, the booking is automatically completed. The Renter's deposit hold (minus any accrued late fees) is released automatically, and the Owner's payout is processed.
- Warning emails are sent at day 5 and day 6 after the end time to both parties before auto-completion.
- The Owner may open a dispute before auto-completion if the item has not been returned or if there are unresolved issues. Opening a dispute pauses the auto-completion timer.
14. Contact Information Sharing
- When a booking is approved, each party's phone number may be shared with the other party to facilitate pickup and return coordination.
- Phone number sharing is opt-in. Each user can control whether their phone number is visible to the other party via their account settings.
- Phone numbers shared through the platform shall only be used for communication related to the rental transaction. Misuse of contact information may result in account suspension.
15. Acceptance
By publishing a listing on the Nerbor platform, the Owner confirms that they have read, understood, and agree to be bound by this Owner Agreement. This Agreement supplements and is governed by Nerbor's Terms of Service.
