By accessing or using the Nerbor platform ("Service"), operated by Nerbor ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
The Service is currently in a beta testing phase. Features may be incomplete, contain bugs, or change without notice. We may reset data, modify functionality, or discontinue the Service at any time during this period. The Service is provided "as-is" without warranties of any kind.
You must be at least 18 years old and legally able to enter binding agreements to use the Service. By creating an account, you represent that the information you provide is accurate and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorized use. We reserve the right to suspend or terminate accounts that violate these terms or that we believe pose a risk to the platform.
Nerbor is a peer-to-peer marketplace connecting equipment owners with renters. We are not a party to rental transactions between users. We do not own, inspect, or guarantee the condition of any listed equipment. Owners and renters are solely responsible for the equipment, rental terms, and their interactions.
Payments are processed through Stripe. By using the Service, you agree to Stripe's terms of service. Rental fees, security deposits, and service fees are charged at the time of booking. Refunds are handled on a case-by-case basis through our dispute resolution process. Owners may issue voluntary partial refunds. Disputed transactions are reviewed by our team.
Either party may open a dispute if equipment is damaged, defective, or if terms are not met. We provide tools for dispute documentation (photos, descriptions) and will review disputes in good faith. Our decisions on disputes during the beta period are final.
To the maximum extent permitted by law, Nerbor shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to equipment damage, personal injury, loss of income, or data loss. Our total liability shall not exceed the fees you paid to Nerbor in the 12 months preceding the claim.
You agree to indemnify and hold Nerbor harmless from claims, damages, or expenses arising from your use of the Service, your violation of these terms, or your interactions with other users.
We may update these terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify users of material changes via email or platform notification.
These terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles.
